These Terms and Conditions govern the use of this website and the basis on which Seri Adil provides legal services to clients. By using this website or engaging our services, you agree to the terms set out below. Please read them carefully. If anything is unclear, please contact us before proceeding.

1. About Us

Seri Adil is a legal chambers practising in pension law and related matters, located at Level 8, No. 36, Jalan Sultan Ahmad Shah, 10050 George Town, Pulau Pinang, Malaysia. We are a member of the Malaysian Bar and hold a current practising certificate. References to "we", "our", or "the chambers" in these Terms refer to Seri Adil.

2. Use of This Website

This website is provided for general informational purposes. Nothing on this website constitutes legal advice, and no solicitor-client relationship is formed by browsing or using this website alone.

You may use this website for lawful purposes only. You must not use it in any manner that could damage, disable, or impair its operation, or interfere with any other party's use. You must not attempt to gain unauthorised access to any part of the website or its associated systems.

The descriptions of our services and fees set out on this website are indicative. The precise scope of work and applicable fees for any engagement are agreed in writing between us and the client before work commences, and those written terms govern the engagement.

4. Our Legal Services

We offer three principal services: Pension Document Review, Mediation and Negotiated Settlement, and Full Representation in Pension Tribunal Matters. Each engagement is governed by a written engagement letter or fee agreement signed by both parties before work begins.

The fees published on this website are current as of the date indicated, but may be updated from time to time. The fee applicable to your engagement is the fee confirmed in writing at the time of engagement, not the fee displayed on the website at any other point.

We do not accept instructions by submission of an online enquiry form alone. An engagement commences only upon execution of a written engagement letter and receipt of any initial payment specified therein.

5. Fees and Payment

Our fees are set out in the engagement letter for each matter. For Full Representation engagements, fees are agreed in writing at each phase before the next phase commences. Payment terms are specified in the engagement letter.

We reserve the right to cease work on any matter if fees are not paid in accordance with agreed terms, provided we give reasonable written notice. In such circumstances, we will take steps to protect your immediate interests to the extent reasonably practicable.

All fees are stated in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise in the engagement letter.

6. Confidentiality

All information you share with us in connection with a potential or actual engagement is treated as strictly confidential. We will not disclose it to any third party without your consent, except where required by law, court order, or our regulatory obligations, or where disclosure is necessarily required for the proper conduct of your matter (for example, to a mediator or tribunal).

Legal professional privilege attaches to communications between you and our chambers made for the purpose of giving or receiving legal advice. Such communications are protected from disclosure in legal proceedings unless you waive that privilege.

7. Limitation of Liability

We aim to deliver our services with care, skill, and professional judgment. However, legal outcomes depend on facts, the evidence available, the positions taken by other parties, and the decisions of mediators and tribunals. We cannot warrant any particular outcome, and nothing in our engagement constitutes a representation that a matter will be resolved in your favour.

Our liability to you in connection with any engagement is limited to direct losses arising from our negligence or professional misconduct, and shall not in any event exceed the fees paid by you in respect of that engagement. We are not liable for any indirect, consequential, or special loss.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Complaints

We take our professional obligations seriously and aim to resolve any concern promptly. If you are dissatisfied with any aspect of our service, please write to us at the address below. We will acknowledge your complaint within five working days and endeavour to provide a substantive response within 21 working days.

If your complaint is not resolved to your satisfaction, you may refer the matter to the Malaysian Bar's Complaints Committee. Details of the complaints process are available on the Malaysian Bar website at www.malaysianbar.org.my.

10. Governing Law

These Terms and any engagement entered into under them are governed by the laws of Malaysia. Any dispute arising from these Terms or from an engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on this page, with the date of the most recent revision indicated at the top. The Terms that apply to any engagement are those in force at the time the engagement letter is signed, not those applying at any later date.
