Our Methodology

How we approach each matter

Every engagement at Seri Adil begins with a reading — of the documents you have, the circumstances you describe, and the question you are trying to answer. From that reading, we assess which of our three services is most likely to serve your needs and explain our reasoning.

We do not recommend a more extensive engagement than the matter warrants. A pension document review that surfaces no urgent concerns does not need to escalate to mediation. Mediation that reaches a settlement does not require tribunal proceedings. The three services are available independently and are chosen based on what the matter actually requires.

Fees for each service are confirmed in writing before work begins. For the mediation and tribunal services, fees are agreed per phase so that progress is made incrementally with a clear picture of the cost at each step.

Initial conversation

You describe the matter. We assess whether it falls within our practice area and, if so, which service is most appropriate. No charge, no commitment.

Written fee agreement

The scope of the engagement and the fee are set out in writing. No work commences until the agreement is signed by both parties.

Document reading and preparation

All relevant documents are read carefully. Written materials — notes, positions, submissions — are prepared to the standard the engagement requires.

Delivery and closing note

The engagement concludes with a written note or report. For phased matters, each phase concludes before the next is agreed.

A careful review of pension documents you have on hand — scheme statements, nomination forms, and correspondence with funds. The review produces a written note identifying matters that may benefit from attention, points of clarity you may wish to confirm with your fund, and considerations for longer-term arrangements.

The note is prepared in plain English and shared with you in both print and electronic form. It is a document you can keep, refer to, and share with family members if that is appropriate to your circumstances.

Service Two

Mediation and Negotiated Settlement

MYR 3,180 — per engagement

A structured engagement for matters where the path forward is most likely to be settled through mediation rather than formal proceedings. Work covers preparation of a written position, attendance at mediation sessions, and follow-up correspondence to formalise any agreement reached.

The engagement is paced so that time is available between sessions for you to consult family members and reflect on the discussions. No decision is expected on the day of any mediation session unless you have indicated that preference clearly in advance.

Service Three

Full Representation in Pension Tribunal Matters

MYR 6,610 — fees agreed per phase

A representation engagement for matters proceeding to formal tribunal hearings concerning pension entitlements, scheme administration, or beneficiary nomination disputes. The engagement covers preparation of written submissions, witness liaison where appropriate, attendance at hearings, and a written report at the close of the matter.

Fees are agreed in writing at each phase and reviewed before the next phase begins. This structure means you retain control of the engagement's progression and are never committed to a future phase that has not yet been scoped and agreed.

Confidentiality

All client communications and documents are held in strict confidence. Legal professional privilege applies. Information is not shared with third parties without written consent.

Written scope and fees

Every engagement is documented before it begins. The scope and fee are agreed in writing. Nothing proceeds beyond the agreed scope without a further written agreement.

Malaysian Bar standards

All legal work is conducted by holders of current Malaysian Bar practising certificates. Professional conduct obligations and continuing development requirements are maintained.

Full documentation

Clients receive copies of all materials prepared on their behalf — in print and electronic form. Records of all correspondence and documents are maintained throughout the engagement.

Timely communication

Responses to client enquiries are provided within one working day. Updates are given at each meaningful stage of the engagement rather than waiting for the client to follow up.

Honest assessment

We describe the position as the documents and facts support it — not as the client would prefer to hear it. Where a matter has weaknesses, those are explained clearly before any engagement proceeds.
